Charles Dix, per ship Isabella, assigned to John Bingle, charged with leaving his station without permission. John Bingle states that about three weeks ago the prisoner came down from his station without permission stating that he wanted a shirt when he had been furnished with a shirt only two months before and likewise a pair of trousers and subsequently a pair of shoes and a frock. The prisoner came into my service about the month of May. The prisoner reported himself sick to the sheep overseer and said that a cart must go up to the station for him.....John Tuckey, states - I am sheep overseer to Mr. John Bingle. The prisoner left his station without permission about a month ago, about a fortnight ago when I was at the station he reported himself so sick that it was necessary a cart should go up and bring him down. I then told him to come down, he said he could not walk. I then said he must wait until a dray could bring him. He however, did not wait but started by himself and came the first day as far as Mr Coxens, not less than ten miles, and the next day came home to the farm....John Wiseman, constable stated that on Saturday last after being at court the prisoner went home the same day Mr. Bingle ordered me to take the prisoner in charge and desired me to observe how he walked. I did so, he kept up with me at the rate of three miles an hour and except that he walked with his legs wide apart, he walked as well as I could. The prisoner in his defence states he has been twice out for the gravel and is still affected with that complaint and that is the reason he cannot work.....The Bench are of opinion that he disobeyed orders by leaving his station without permission and although he had the complaint of which he complains, not to such an extent as he states. The Bench find him guilty and sentence him to 14 days solitary confinement in the cells at Newcastle and to be returned to his master, being in the first instance taken to the surgeon for examination

Charles Dix charged with pretending to be sick and thereby deceiving the Bench.....Thomas Dunn, constable and lock up keeper states that on last Sunday week the chest belonging to the court house was down at the court house and as Witman was going away with prisoner I went to bring it up to my own place for safety, the prisoner was with me and I asked him to wheel it up for me on the wheelbarrow which he did. I asked him what he would say if his overseer saw him jumping about. He said damn the overseer, that it was all over now and that he did not care what he did as court day was over and he walked as well as I could. The Bench referring to the foregoing deposition sentence Charles Dix to receive fifty lashes

James Reynolds per ship Marquis of Huntley, Charles Brewhouse per ship Marquis of Hastings, Charles Dix per ship Isabella all assigned to John Bingle, all charged with neglect of duty. John Tuckey states - I am overseer to Mr. Bingle and the prisoners Reynolds and Dix are employed as shepherds and Brewhouse as watchman; on last Thursday as I was going down the creek I found only half of the prisoner Reynolds flock on this side of the creek and the others half on the other side of the creek at a considerable distance from the others. I did not see the prisoner until I had brought them across the creek to the other part of the flock. I then saw him and asked where he had been ; he said he had been there all the time; he Reynolds has particular orders not to cross the creek with the sheep; on Friday last the prisoner Dix allowed a native dog to get into his flock which separated twenty six from the flock, since which on Monday last the prisoner brought home his flock two short of which he could give no account; on Monday morning about daylight I heard a noise and got up and saw the four flocks under the charge of the prisoner Brewhouse all out of the folds and admixed together. I went to the prisoners watch box and found him there but not asleep. I asked how he allowed him sheep to get out; he said he was unwell; he however got up and assisted me to collect the sheep and neither before nor since has expressed a wish to go to a medical man who he must know as living on the spot. The prisoner Reynolds states in his defence that he was sitting near his flock mending his trowsers and that he has bad sight and could not see well. The prisoner Brewhouse states in his defence that he was unwell and not able to get up. The prisoner Dix states that he did his best to keep his sheep together. The Bench find the prisoner guilty and sentence them to fifty lashes each
